The first 72 hours matter
Hit by an 18-Wheeler in Dallas? Act Before the Evidence Disappears
Trucking companies and their insurers often send investigators to the scene within hours. Here's how to protect your 18-wheeler claim.
Get treated, and keep records
Truck crashes cause serious injuries. Major trauma care in the area is provided by Parkland Memorial Hospital (Level I trauma center), Baylor University Medical Center and Methodist Dallas Medical Center.
Get the truck's details
Photograph the cab doors (company name, USDOT number), the trailer and plates, and the scene. The CR-3 crash report from Dallas Police Department or Texas DPS also lists the carrier.1
Preserve the black box
Engine control module (ECM) data, ELD driving logs and dash-cam video can be overwritten. We send preservation (spoliation) letters right away.2
Don't talk to the trucking insurer
Their rapid-response adjusters are building a defense. Don't give a recorded statement. Refer them to us.
Don't sign anything
Quick settlement offers in truck cases are often far below what the claim is worth. Signing a release ends your claim.
We front the experts
Accident reconstruction, trucking-safety experts, downloads of the truck's data. No recovery, no attorney fee.
Federal trucking rules
Why Truck Cases Are Different: FMCSA Rules, Black-Box Data, Multiple Insurers
Semi trucks and 18-wheelers on Dallas highways must follow Federal Motor Carrier Safety Administration (FMCSA) rules. When a trucking company breaks them, that can prove fault. A Dallas truck accident attorney on our team checks each one:
Property-carrying drivers may drive up to 11 hours after 10 consecutive hours off duty, can't drive beyond the 14th hour after coming on duty, and must take a 30-minute break after 8 hours of driving. 60/70-hour weekly limits apply.3
49 CFR Part 395Most interstate drivers must record duty status on an ELD. That data, plus the truck's ECM "black box," shows speed, braking and hours.2
49 CFR Part 395, Subpart BCarriers must keep driver qualification files: license, driving record, road test and medical certificate. Hiring an unqualified driver can make the company liable.4
49 CFR Part 391CDL drivers are subject to pre-employment, random and post-accident testing. A missed post-crash test is a red flag.5
49 CFR Part 382Carriers must inspect, repair and maintain their trucks and keep records. Brake and tire failures are common in 18-wheeler wrecks.6
49 CFR Part 396Loads must be secured to prevent shifting or spilling, and lights, brakes and reflective devices must meet federal standards.7
49 CFR Part 393Texas DPS commercial vehicle enforcement applies many of the same safety rules to Texas carriers.

Cases we handle
Dallas 18-Wheeler & Commercial Truck Cases We Handle
Jackknife & rollover crashes
Sudden braking, speed and shifting loads can fold or roll a trailer across several lanes.
Underride collisions
Cars sliding under a trailer's rear or side cause some of the most severe injuries we see.
Rear-ended by a semi
A loaded 18-wheeler needs far more distance to stop. Following too close or fatigue is often to blame.
Wide-turn & blind-spot crashes
Lane changes into "no-zones" and wide right turns at frontage-road intersections.
Delivery & box trucks
Amazon, FedEx and box-truck crashes from the Inland Port and Stemmons distribution centers into Dallas neighborhoods.

Dallas Truck Accident FAQs
How long do I have to file a truck accident claim in Texas?
In most Texas injury cases, the deadline to file a lawsuit is two years from the date of the crash.12 Claims involving a city, county or other government vehicle can require written notice much sooner. Evidence such as camera footage and truck data disappears far sooner, so it pays to start early.
What if I was partly at fault?
Texas uses proportionate responsibility: you can recover as long as you are not more than 50% responsible, and your recovery is reduced by your share of fault.13 Don't accept the insurer's version of fault. Get a free review first.
Where would my Dallas case be filed?
Most claims settle without a lawsuit. If one is needed, Texas venue rules generally allow filing in the county where the crash happened or where the defendant lives.14 For a crash in Dallas, that is usually the George L. Allen, Sr. Courts Building (Dallas County civil district courts), 600 Commerce St., Dallas.11
Do you have an office near me in Dallas?
Principal office: Lakeway, TX. We meet DFW clients by phone or video.
What does it cost to hire a truck accident lawyer?
Nothing up front. The consultation is free, we front the costs of building your case, and we only collect an attorney fee if we recover money for you. Court costs and case expenses may apply and are explained in your agreement before you sign.
How much insurance does a trucking company have to carry?
Federal rules set minimum liability coverage for interstate motor carriers. For example, $750,000 for many for-hire carriers hauling general freight in vehicles of 10,001 lbs or more, and more for certain hazardous materials.15 Many carriers have more coverage, and finding every policy is part of our job.
The driver says he's an independent contractor. Can I still go after the company?
Often, yes. Federal rules make the motor carrier responsible for the driver operating under its authority. Brokers, shippers, loaders and maintenance shops can share responsibility too. We look at every company in the chain.
The trucking company's adjuster called me the day after the crash. Should I talk to them?
No, not before you speak with a lawyer. Trucking insurers often have rapid-response teams on scene within hours. Anything you say can be used to reduce your claim. Refer them to us.
